Preamble

User: a “User” is a contact of an Agency client of one of the solutions of the company Apiwork SA or through its network of resellers.
Agency: an “Agency” is a client in the real estate sector who has subscribed to one of Apiwork SA's solutions or through its network of resellers.
Subcontractor: Apiwork SA refers to the “Subcontractor” acts as a technical service provider who manages the storage of User and Agency data.
Subscription contract: the “Subscription contract” defines the services subscribed to by the Agency with the Subcontractor.

The Subcontractor attaches particular importance to the protection of your personal data (or “personal data”).
The purpose of this Notice is to define, in accordance with Article 28 of the GDPR, the conditions under which the Subcontractor processes Personal Data on the User's instruction as part of the services defined in the Subscription Contract.

For the purposes of this part, the Agency is presumed to act as Data Controller. If the Agency acts as a Subcontractor on behalf of a third party responsible for processing, the Parties expressly agree that the following conditions apply:

As data controller, we are responsible for collecting and processing the User's personal data as part of real estate project.
The purpose of this Notice is to inform the User about the personal data we collect about them, the reasons for which we use and share them, for how long we keep them, what are your rights and how you can exercise them.

1. Scope of Personal Data

We collect and use personal data, namely any information that identifies the person connected, to the extent necessary in the context its real estate project, and thus to provide you with access to the data as part of our mission as Processor (see paragraph 2).

Depending in particular on your level of access and the service we provide to you, we collect different types of personal data, in particular:

• • information of the User's private and/or professional (for example: surname, first name, company name, postal address, e-mail address, telephone number, family situation, nationality, search criteria, identity document, contracts related to your activity…) (see paragraph 2);

We never ask you to provide other sensitive data such as data relating to your racial or ethnic origin, your political opinions, your religious or philosophical beliefs or relating to your trade union membership, genetic data or data relating to your life or your sexual orientation, unless a legal obligation requires us to do so.

As a User, if the information provided by the Agency does not respect your privacy, we invite you to contact us (see paragraph 4).

The User is also requested not to divert the use of the fields of the various forms to add this type of information.

2. Collection of personal data

We collect data directly from Agency that follows your real estate project.

You can access this personal data from your “Subscription” area after you have logged in. Also you can update this information and your subscriptions.

Our system can automatically purge your data when your research project is not generating any activity (around 36 months).

3. Personal data policy with our partners

Our services allow Agencies to collect confidential data from third-party applications (eg Google, Microsoft Office 365, etc.).
These personal data are used to synchronize their calendars, classify their e-mails, send an e-mail from their e-mail server, etc.
